Notes for use (not part of the resolution):
- This is a draft based on the August 5, 2024 Employment Agreement (publicly available via City agenda materials), RCW 35A.13.130–.140, the City’s Governance Coordination Manual (majority of the whole Council required for removal), and standard Battle Ground resolution format.
- Under state law, the resolution must state the Council’s intention and the reasons (even for “without cause”). The draft uses a neutral “best interests” reason; the Council may refine the language.
- A reply and possible public hearing process under RCW 35A.13.140 may apply if the City Manager timely replies in writing.
- Severance is contractual (12 months’ salary + deferred compensation match + health/welfare benefits). Confirm the exact current salary and benefits with the Finance/HR departments before finalizing payment language.
- Placeholders (resolution number, exact meeting date, optional suspension language) should be completed by the City Clerk/Attorney. Legal review by the City Attorney is essential before introduction or adoption.
- This draft assumes the current Mayor as of early 2026 information; update the signature block if needed.
This is a formal draft only and does not constitute legal advice. The City should have its attorney review and finalize any official resolution.
